About This Notice

Nocturyn LLC provides technology, scheduling, communication, operational, administrative, payment-processing, and reimbursement-support services for independently licensed healthcare providers participating in the Nocturyn network.

Clinical services are provided solely by independently licensed healthcare providers. Each provider remains solely responsible for all diagnoses, treatment recommendations, prescribing decisions, documentation, and clinical judgment.

Nocturyn does not practice medicine and does not provide clinical care.

Clinical records are maintained by the treating provider and are subject to the provider's professional and legal obligations.

How Your Information May Be Used And Disclosed

Your information may be used and disclosed for purposes permitted by applicable law, including the following.

Treatment

Healthcare providers participating in the Nocturyn network may use and disclose information to provide, coordinate, and manage your care.

Payment

Information may be used to process payments, generate receipts, create superbills, facilitate authorized out-of-network reimbursement support, submit patient-authorized out-of-network claims after completed services, verify eligibility and benefits for claim-submission purposes after services have been provided, and perform related administrative payment activities.

Out-of-network claim submission support is provided solely as a complimentary administrative filing service.

Nocturyn does not determine eligibility, coverage, reimbursement amounts, claim approval, claim denial, or appeal outcomes. Nocturyn does not negotiate reimbursement, settle claims, appeal denials, or act as an insurer, insurance adjuster, third-party administrator, or insurance representative.

All reimbursement decisions are made solely by the patient's insurance carrier.

Healthcare Operations

Information may be used for quality improvement, credentialing, compliance activities, platform administration, customer support, security monitoring, auditing, training, and operational functions necessary to support healthcare services.

Business Associates

Nocturyn and participating providers may share information with vendors and service providers who perform services on their behalf and who are contractually required to safeguard information as required by law.

Uses And Disclosures Required Or Permitted By Law

Information may be disclosed when required or permitted by law, including:

Public health activities

Health oversight activities

Court orders and lawful legal process

Law enforcement requests

Reporting abuse, neglect, or domestic violence

Preventing serious threats to health or safety

Workers' compensation matters

Other legally authorized purposes

You have the right to:

Request access to your health information.

Request correction of inaccurate information.

Request restrictions on certain uses or disclosures.

Request confidential communications through alternative methods or locations.

Request an accounting of certain disclosures.

Some requests may be subject to legal limitations or exceptions.

Because clinical records are maintained by the treating provider, certain requests regarding access, amendment, restrictions, or accounting of disclosures may need to be directed to the provider or professional entity responsible for your care.

How Nocturyn Protects Information

Nocturyn maintains administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, or destruction.

Where required by law, Nocturyn enters into Business Associate Agreements and implements security measures intended to support compliance with applicable privacy and security requirements.

Breach Notification

If Nocturyn becomes aware of a breach of unsecured protected health information requiring notification under applicable law, affected individuals will be notified as required by law.

Complaints

If you believe your privacy rights have been violated, you may submit a complaint without fear of retaliation.
