About This Policy

Nocturyn is an overnight healthcare access platform operated by Nocturyn LLC. This Privacy Policy describes how Nocturyn collects, uses, stores, and protects information submitted through nocturyn.com and the Nocturyn platform.

By using the Nocturyn platform or joining the waitlist you agree to the practices described in this policy. If you do not agree do not submit your information or use the platform.

What We Collect

When you join the Nocturyn waitlist or use the platform we collect the following information you provide directly.

Full name. Email address. Phone number. State of residence. Service type preference. Preferred contact method. Preferred session time window. Provider gender preference. Acknowledgment of cash pay model. Communication consent status.

After October 26th 2026 when the platform is active we additionally collect the following information. Booking information including session dates, session types, and session durations. Payment records and transaction history. Insurance information including insurer name, member ID, and group number collected solely for out of network claim submission purposes when you opt into and authorize our OON submission service. Post-session survey responses. Session modality selections and provider-documented clinical rationale for audio-only sessions where applicable. Out of network claim submission authorization status and claim submission records. Phone consultation records.

We do not collect clinical or diagnostic information at the waitlist stage. We do not sell your information. We do not share your information with advertisers.

Health Related Information

Service type preferences and condition descriptions you submit may constitute health-related information. Nocturyn treats this information with heightened care. This information is used only to facilitate your provider match and improve access to appropriate care. It is not shared with any third party except as necessary to complete your match.

Nocturyn LLC facilitates connections between patients and independent providers. Once you engage with a provider through the platform clinical records are created and maintained by the independent provider under their own HIPAA Notice of Privacy Practices. Nocturyn LLC processes administrative, operational, scheduling, communication, payment-processing, reimbursement-support, and related non-clinical information necessary to operate the platform and support patient access to care.

Insurance information including your insurer name, member ID, and group number is treated with the same heightened care as health-related information. This information is collected solely for the purpose of out of network claim submission when you have explicitly authorized this service at booking. It is accessed only by the care coordination team members responsible for claim submission and is never used for any other purpose.

HIPAA

Nocturyn LLC may perform certain administrative and operational functions on behalf of participating providers. Where required by law, Nocturyn LLC enters into Business Associate Agreements and maintains administrative, physical, and technical safeguards designed to protect protected health information in accordance with applicable law.

How We Use Your Information

We use the information you provide for the following purposes only.

To match you with an appropriate provider before your first session.

To contact you by your preferred method about your waitlist status, scheduling, and platform access.

To understand demand by service type, geography, and availability to recruit appropriate providers.

To send transactional and platform communications you have consented to receive.

To process payments for booked sessions.

To improve platform operations and patient experience using aggregated anonymized data.

To facilitate authorized out-of-network reimbursement support, including generation of superbills, submission of patient-authorized out-of-network claims after completed services, post-service eligibility and benefits verification related to claim submission, and related administrative activities necessary to support the claim-submission process.

To generate superbills containing your session information for your records and potential insurance submission.

We do not sell your information. We do not share your information with advertisers. We do not use your information for any purpose beyond what is listed above.

What We Do Not Do With Your Information

Nocturyn does not sell your personal information to any third party. Ever.

Nocturyn does not share your personal information with advertisers or data brokers. Ever.

Nocturyn does not use your health information for marketing or advertising targeting of any kind.

Nocturyn does not share your insurance information for any purpose other than processing your explicitly authorized OON claim submission.

Nocturyn does not retain your insurance credentials beyond what is necessary to process your authorized claim.

How We Store Your Information

Your information is stored securely in Nocturyn platform systems. Access is limited to authorized Nocturyn personnel only. We use industry standard security practices to protect your data from unauthorized access, disclosure, or destruction. While no system can guarantee absolute security, Nocturyn maintains reasonable administrative, technical, and physical safeguards designed to protect information consistent with applicable law and industry practices.

We retain your information for as long as necessary to fulfill the purposes described in this policy or as required by law. You may request deletion of your information at any time by contacting privacy@nocturyn.com. We will respond within 30 days.

Third Party Services

Nocturyn uses third party technology vendors to operate the platform including form collection services, email communication services, contact management systems, SMS communication services, clinical scheduling and records systems, payment processors, and workflow automation tools. These vendors are contractually prohibited from using your information for any purpose other than providing services to Nocturyn. We do not authorize any third party to sell or monetize your information.

Clinical session records are stored in a HIPAA compliant clinical platform under a Business Associate Agreement. No clinical data is stored in non-clinical administrative systems.

A current list of our technology vendors is available upon request by contacting privacy@nocturyn.com.

Examples of vendors may include payment processors, scheduling platforms, communication platforms, electronic health record systems, secure messaging systems, cloud hosting providers, analytics providers, and workflow automation providers.

Session Modality and Recording

Nocturyn sessions are delivered primarily via video telehealth. Audio-only telehealth is available for established patients only when the provider independently determines it is clinically appropriate. Audio-only sessions are documented in your session record including the provider's clinical rationale.

Sessions are not recorded by Nocturyn or by your provider without your explicit separate written consent. If session recording is offered as an opt-in service in the future recordings will be stored in HIPAA-compliant storage, accessible through your patient portal for 30 days, and permanently deleted after 30 days with advance notice to you.

SMS and Mobile Communications

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All SMS opt-in data and consent information will not be shared with any third parties. You may opt out of text messages at any time by replying STOP to any text from Nocturyn.

Do Not Track

We do not currently respond to Do Not Track browser signals. If a universal standard for online tracking is adopted that we must follow we will update this policy accordingly.

California Privacy Rights

If you reside in California you have rights under the California Consumer Privacy Act including the right to request access to, correction of, or deletion of your personal information, and to opt out of the sale or sharing of your personal information. Nocturyn does not sell personal information. To exercise your rights contact privacy@nocturyn.com.

Florida and New York Privacy Rights

Florida and New York residents may have rights regarding access to and correction of certain personal information under applicable Florida and New York law. To exercise any available rights contact privacy@nocturyn.com.

Other State Privacy Rights

If you reside in a state not listed above you may have similar rights to access, correct, or delete your data depending on applicable state law. To exercise these rights contact privacy@nocturyn.com.

Your Rights

You have the right to access the information we hold about you. You have the right to correct inaccurate information. You have the right to request deletion of your information. You have the right to withdraw consent for communications at any time. Contact privacy@nocturyn.com to exercise any of these rights. We will respond within 30 days.

Children

Nocturyn is not directed at individuals under the age of 18. We do not knowingly collect information from anyone under 18. If you believe a minor has submitted information through our platform contact us immediately at privacy@nocturyn.com.

Emergency Notice

If you are experiencing a medical emergency call 911 immediately. For mental health crisis support call or text 988. Nocturyn is not an emergency service.

Changes to This Policy

We may update this Privacy Policy as the platform develops. Material changes will be communicated via email. The effective date at the top of this page reflects the date of the most recent update. Continued use of the platform after changes are posted constitutes acceptance of the updated policy.
