Telehealth Consent

Effective Date: October 26th 2026
Nocturyn LLC

About This Consent

By booking a session through the Nocturyn platform you consent to receiving care via telehealth. Please read this document carefully before your first session. You have the right to withdraw this consent at any time without affecting your right to seek care through other means.

What Is Telehealth

Telehealth allows you to meet with a licensed healthcare provider remotely using secure electronic communication technology. You do not need to travel to a clinic or office. Your session takes place from wherever you are physically located as long as you are in a state where your provider is licensed at the time of the session.

Nocturyn offers the following telehealth modalities.

Video telehealth: Real-time audio and video connection. The default modality for all sessions. Required for all new patient initial evaluations without exception. You must have a stable internet connection and a functioning camera.

Audio-only telehealth: Real-time audio connection without video. Available for established patients only when your provider independently determines that audio-only is clinically appropriate for your specific situation at that specific time. Audio-only is never available for new patient initial evaluations. Your provider documents their clinical rationale for audio-only in your session record. You will be informed at session start if your provider determines audio-only is appropriate.

Phone consultations: Fifteen-minute telephone orientation calls available to all patients on demand during operating hours. Conducted by a licensed healthcare provider participating in the Nocturyn network. Phone consultations are not comprehensive clinical evaluations and do not establish an ongoing patient-provider treatment relationship. The fee is displayed at booking and applies as a full credit toward your first full session if booked within 72 hours.

What To Expect

Your session will take place via secure video through Nocturyn's clinical scheduling platform. Your provider will confirm your identity and physical location at the start of every session. You should be in a private space where you cannot be overheard. Your session will not be recorded by Nocturyn or your provider without your explicit separate consent.

If your session is conducted via audio-only modality your provider will inform you at the start of the session and document their clinical rationale in your session record. If your session is a phone consultation your provider will call you at your confirmed phone number at the scheduled time. If a technical failure occurs during your session your provider will determine the appropriate next step based on your patient status and their clinical judgment.

Benefits Of Telehealth

Convenient access to psychiatric and therapeutic care from your location.

No travel required.

Access during evening and overnight hours when in-person care is not available.

Reduced exposure to illness.

Flexible scheduling within available provider windows.

Risks Of Telehealth

Your provider cannot perform certain in-person assessments that may be relevant to your care.

Technical difficulties including poor internet connection or device failure may interrupt or delay your session.

Telehealth may not be appropriate for all conditions. Your provider will advise you if in-person care is recommended.

Electronic transmission of health information carries inherent privacy risks despite security measures in place.

Audio-only sessions limit your provider's ability to conduct visual clinical assessment. Clinical impressions during audio-only sessions are based solely on verbal communication and your established patient history. Your provider may recommend transitioning to video or rescheduling if they determine visual assessment is clinically necessary.

Phone consultations are orientation calls only and do not constitute a comprehensive clinical evaluation. Clinical decisions cannot be made solely on the basis of a phone consultation.

Privacy And Security

Nocturyn uses secure HIPAA compliant technology for all sessions. Your session information is handled in accordance with Nocturyn's Privacy Policy and your provider's Notice of Privacy Practices. No one other than your provider will be present during your session without your prior knowledge.

Provider Independence

Nocturyn provides technology, scheduling, communication, operational, and administrative support services. Clinical services are provided solely by independently licensed healthcare providers participating in the Nocturyn network. Each provider remains solely responsible for all clinical decisions, diagnoses, treatment recommendations, prescribing decisions, documentation, and medical care. Nocturyn does not practice medicine and does not direct clinical judgment.

Your Rights

You have the right to withdraw your consent to telehealth at any time without affecting your right to seek care through other means.

You have the right to request an in-person referral if telehealth is not appropriate for your condition.

You have the right to access your session records as permitted by law.

You have the right to ask your provider who else may be present during your session.

You have the right to end a session at any time.

Emergencies

Nocturyn is not an emergency service. If you are experiencing a medical emergency call 911 immediately or go to your nearest emergency room. If you are in mental health crisis call or text 988. Do not wait for a Nocturyn session in an emergency situation.

Audio-Only And Phone Consultation Consent

Audio-only telehealth: By using the Nocturyn platform you consent to receiving care via audio-only telehealth for established patient sessions when your provider independently determines it is clinically appropriate. You acknowledge that audio-only sessions do not include visual assessment. You acknowledge that your provider's clinical impressions during audio-only sessions are based solely on verbal communication and your established patient history. You understand that your provider may recommend transitioning to video or rescheduling at any time if they determine visual assessment would improve your care. You may express a preference for rescheduling over audio-only and your provider retains sole clinical discretion over the final decision.

Phone consultations: You understand that phone consultations are fifteen-minute orientation calls conducted by a licensed healthcare provider participating in the Nocturyn network. You understand that phone consultations are not comprehensive clinical evaluations and do not establish an ongoing patient-provider treatment relationship. You understand the phone consultation fee is displayed at booking and applies as a full credit toward your first full session if booked within 72 hours. You understand that the phone consultation fee is retained if a full session is not booked within 72 hours.

Technical failures for new patients: You understand that if a technical failure prevents your new patient initial evaluation from proceeding via video your session will be rescheduled at no additional charge with your original session fee credited in full. Audio-only is not available as a fallback for new patient initial evaluations under any circumstances.

Technical failures for established patients: You understand that if a technical failure occurs during your established patient session your provider will determine at their clinical discretion whether to continue via audio-only if clinically appropriate or reschedule. You may express a preference for rescheduling and your provider retains sole clinical discretion over the final decision. If your session is rescheduled your original session fee is credited in full toward your rescheduled session.

State-Specific Requirements

Telehealth laws vary by state. Your provider may be subject to additional licensing, consent, documentation, prescribing, privacy, identity verification, or telehealth requirements based upon the state in which you are physically located at the time of service.

By booking a session, you agree to accurately disclose your physical location at the start of each session and understand that your provider may be unable to provide services if they are not authorized to practice in your location.

Additional state-specific disclosures, acknowledgments, notices, and consents may be presented before booking, during intake, or prior to receiving services, as required by applicable law.

Acknowledgment

By completing your booking you confirm that you have read and understood this Telehealth Consent in full. You voluntarily consent to receiving care via telehealth through the Nocturyn platform including video telehealth as the default modality for all sessions. You consent to audio-only telehealth for established patient sessions when your provider independently determines it is clinically appropriate and documents their rationale. You understand the benefits and risks described above including the specific limitations of audio-only sessions. You understand your right to withdraw this consent at any time without affecting your right to seek care through other means. You understand that your physical location at the time of service determines which state's telehealth laws govern your session. You confirm that you will accurately disclose your physical location at the time of each session and understand that your provider may be unable to provide services if they are not authorized to practice in your location. You understand that new patient initial evaluations require video without exception and that audio-only is never available as a fallback for first sessions.
